Cassidy JUST DAYS AFTE R a Senate com mit tee approved an amendment to an appro- priations bill that would suspend some changes to federal truck driver hours of service rules implemented last July, debate exploded. A June 7 crash in New Jersey killed comedian and writer James McNair and injured comedian and television star Tracy Morgan, putting the issue of truck driver fatigue on the national stage. The amendment, introduced this month by Sen. Susan Collins, R-Maine, would sus- pend the requirement that drivers include two 1 a.m.-to-5 a.m. periods in their 34-hour restart and only take a restart once within a week. The requirement that drivers take a 30-minute break within their first eight hours on duty would remain. The Wal-Mart accident focused media attention on truck driver fatig ue and spurred a backlash against the Senate com- mittee's decision, throwing trucking groups that hailed the Senate move on the defensive and emboldening those who would like to see even stricter truck driver work rules. Sen. Dianne Feinstein, D-Calif., vowed to fight the amendment. "New Jersey pros- ecutors say the truck driver who caused the crash had been awake for more than 24 hours prior to the accident," she said. "This highlights why I am committed to combat- ting truck driver fatigue." Sen. Charles Schumer, D-N.Y., wants federal regulators to require trucking compa- nies to put electronic logging devices in their vehicles in a matter of months, rather than in years. At a June 15 press conference, Schumer urged the Department of Transportation to bring years of debate over electronic logs to a conclusion and to get a proposed rule man- dating their use on the books. "The tragic accident ... could have been prevented had Wal-Mart's driver been prop- erly rested rather than reportedly going 24 hours without a break," said James P. Hoffa, Teamsters union general president. Hoffa urged members of the House to reject any legislation that would revise the 2013 rule on driver hours or lift truck size and weight lim- its when crafting federal appropriations bills.
